TERMS & CONDITIONS FOR THE SALE OF TICKET(S)

These terms and conditions apply to any purchase of Tickets.

INTERPRETATIONS

The Reader’ (and ‘We’, ‘Our’, ‘Ours’ and ‘Us’) refers to The Reader Organisation, registered in England and Wales with charity number 1126806 (SCO43054 Scotland) and company number 06607389 whose registered office is at The Reader Mansion House, Calderstones Park, Liverpool, L18 3JB who is the Trader for the purposes of The Consumer Rights Act 2015.

Event’ means an entertainment event including, without limitation, a performance, a session, a concert, exhibition, theatrical and/or music event to be held at a Venue in respect of which We have the right to sell You Tickets.
‘Promoter’ means the person firm or company staging the Event if different from Us.
‘Website’ means http://www.thereader.org.uk

‘Ticket(s)’ means printed, electronic or other type of evidence (including a wristband) of the right to occupy space at or to attend an Event sold by Us to You.
‘Voucher(s)’ means a gift You purchase from Us.
‘Working Day’ means Monday to Friday, excluding any Public or Bank Holidays.
‘You’ means you or anybody who in Our reasonable opinion is acting with your authority or permission.
‘Your’ shall be read accordingly.

Your contract for the purchase of Ticket(s) is formed as soon as We have processed Your payment and will expire immediately after the performance of the Event for which You purchased Ticket(s). However, any purchases are subject to payment card verification and other security checks and Your transaction may be cancelled if it has not passed Our verification processes.

The Reader reserves the right to change these general terms and conditions which are applicable to all retail offers and discounts at any time without prior notice by amending these online.

These terms and conditions also apply to the reservation of a Calderstones Card membership discounts and any loyalty schemes.

TICKETS, PRICES AND PAYMENTS

  • All Tickets are sold subject to availability. A valid Ticket must be produced to enter the Event.
  • It is Your responsibility to check Your Ticket(s) as mistakes cannot always be rectified after purchased.
  • The price of the Ticket shall be the price set at the time We accept Your order.
  • No order will be accepted until We have received full payment in cleared funds.
  • Only one Concession or Discount is available per ticket.
  • Ticket prices are subject to change. We reserve the right to change the prices of tickets and/or introduce discounts/special offers which cannot be retrospectively applied to tickets already purchased.
  • Concessions and Discounts may be restricted to certain events and can be withdrawn by The Reader without notice.
  • Customers must state discounts they are entitled to at the time booking. Proof of entitlement to a concession/discount/essential companion ticket may be requested from the customer at the time of booking and/or when they attend the event. Failure to produce reasonable proof of entitlement to a concession/discount/essential companion ticket may invalidate the ticket and result in the refusal of admittance or ejection from the event.
  • We have a limited number of free essential companion Tickets available. These must be booked through the box office.
  • We will not be responsible for any Ticket that is lost, stolen or destroyed.
  • It is not always possible to issue duplicate Ticket(s). For example, for non-seated events where there is a possibility of both the original and duplicate ticket(s) being used, compromising the licensed capacity of The Reader. Duplicates may therefore be issued at the discretion of The Reader.

DELIVERY

  • The Reader does not offer a delivery service for Ticket(s).
  • Tickets delivered as “Print at Home” – your Tickets will be delivered as an E- Ticket to the email address provided by You during the transaction.

REFUNDS / EXCHANGES

  • Tickets are non-refundable after purchase unless the Event is cancelled or rescheduled by the The Reader or Promoter. In this instance, the original Ticket purchaser will be eligible to claim a refund.
  • Ticket exchanges cannot be guaranteed but may be offered at our discretion and where there is an additional programmed date/time of the same event. This is subject to availability.
  • Any requests for ticket exchanges must be sent to [email protected] no later than 48 hours before the Event start time.
  • Where an exchange results in an increase in ticket price, the ticket purchaser is required to pay the outstanding balance. In addition, any exchanges to lower priced tickets will not be subject to a refund.
  • Refunds shall only be made to the person who purchased the Tickets and, when possible, be made using the same method used to purchase the Tickets.

CHANGES TO EVENT

  • We reserve the right to make alterations to the published Event programme where reasonably necessary. Where such alteration is a material change You will be entitled to claim a refund.
  • A ‘material’ change to the programme of the Event is a change which, in Our reasonable opinion, makes the Event materially different to the Event that purchasers of the Ticket, taken generally, could reasonably expect. The use of understudies in a theatre performance shall not be a material change.
  • It is the customer’s responsibility to check whether an event has been cancelled or rescheduled. In such cases The Reader will make all reasonable endeavours to notify customers of the change but cannot guarantee all will be informed before the event.

WEATHER

  • In the event of wet weather scheduled performances will proceed as planned.
  • Events will only be cancelled if weather conditions pose a safety risk to patrons, performers and staff.
  • In the event of a cancelled performance due to weather and safety conditions, You will have the option to exchange Your tickets for a future performance of the same Event (subject to availability) or receive a full refund.
  • The Reader will contact all Event bookers using the contact information used to purchase the Tickets with details about how to claim a refund. Ticket holders should contact our box office at [email protected] if they have not heard from us within 5 working days of the cancellation.

RESALE OF TICKETS

  • Tickets sold are for private use only. You and/or any Ticket Holder or any member of a Group must not re-sell, or seek to re-sell, the tickets in breach of these terms and conditions. Any breach of this condition will entitle us to invalidate the Tickets and refuse entry without prior notification, refund, compensation or liability.

VOID TICKETS

  • Any Ticket obtained in breach of these terms and conditions shall be void and all rights conferred or evidenced by such Ticket shall be void.

VOUCHERS

  • All references to 'Ticket(s)’ in these Terms and Conditions also includes Vouchers.
  • Your contract for the purchase of Vouchers is formed as soon as We have processed Your payment and, in the case of Vouchers will expire within 12 months and must be used within such time periods as they cannot be extended.

RESTRICTIONS

  • Ticket(s) may be restricted to a maximum number or sold subject to certain restrictions on entry or use, such as restricted, obstructed or side view or a minimum age for entry. Any such restriction shall be displayed on Our website or otherwise notified to You before or at the time You book the Ticket(s). It is Your responsibility to ensure that You read all notifications displayed on Our website. We reserve the right to cancel Ticket(s) purchased in excess of the maximum number, without prior notice unless the purchase of Ticket(s) in excess was due to Our error, in which case We will notify You prior to cancelling Your Ticket(s).
  • Mobile telephones and messaging equipment must be switched off during the Event.
  • The following items are not permitted at the event:
    • Alcohol, unless purchased from The Reader at the Event.
    • Drugs or illegal substances including ‘legal highs’
    • Glass
    • Knives or weapons
    • Smoking and use of electronic cigarettes is not permitted anywhere at The Reader
  • We reserve the right to conduct security searches from time to time and to confiscate any item which may cause danger or disruption to others or if one of the Non-Permissible Items listed above is suspected or found.
  • Anyone under the age of 15 years must be accompanied by a responsible adult of 18 years or older unless stated otherwise on the event page.

CONDITIONS OF ADMISSION AND ATTENDANCE

  • The management of The Reader reserves the right to refuse Ticket holder’s admission to the event in reasonable circumstances including for health and safety, licensing reasons or where a Ticket is void.
  • The management also reserves the right to request that Ticket holders to leave at any point on reasonable grounds and may take any appropriate action to enforce this right. By way of example only, the The Reader may remove a Ticket holder who:
    • has behaved at the event in a manner which, in the reasonable opinion of The Reader has, or is likely to affect the enjoyment of other visitors; or
    • uses threatening, abusive or insulting words or behaviour or in any way provokes or behaves in a manner which may provoke a breach of the peace; or
    • in the reasonable opinion of The Reader is under the influence of drugs or has consumed an excessive amount of alcohol; or
    • fails, when required, to produce proof of identity or age; or
    • obstructs gangways, access-ways, exits, entrances or staircases, congregates in non-designated areas or seeks entry to Events which he/she does not hold a Ticket.
  • You must comply with instructions and directions given by staff and stewards.
  • It is the customer’s responsibility to assess the suitability of an event for children where no official age restriction applies.
  • Every effort shall be made to admit latecomers to Events at a suitable break in the Event, but late admission cannot be guaranteed.

RESTRICTIONS AND PROHIBITIONS

  • The use of equipment for recording or transmitting (by digital or other means) any audio, visual or audio-visual material or any information or data at The Reader is strictly forbidden. Unauthorised recording equipment, recordings, tapes, films or similar items may be confiscated and destroyed or deleted. Any recording made of an Event in breach of these conditions shall belong to The Reader who will not be liable for any loss, theft or damage to confiscated items.
  • The use of equipment to record or transmit audio and/or visual material at The Reader is strictly forbidden. Unless the use is explicitly consented to by the performing act, mobile telephones, messaging equipment and all similar personal electronic equipment must be switched off during the event. Customers who do not comply and disrupt the enjoyment of the event for other customers may be ejected from the The Reader without refund.
  • We reserve the right for Filming and Photography to take place at an event for any purposes including commercial promotion without prior notification. When taking place, signage will be clearly visible to inform ticket holders. You reserve the right to request that your image is not used for this purpose and such requests should be made to a member of staff at the event.

LIABILITY

  • Personal arrangements including travel, accommodation or hospitality relating to the Event which have been arranged by You are at your own risk.
  • We will not be responsible for any loss, theft or damage of your personal belongings, other than caused as a result of Our negligence or other breach of statutory duty.
  • Nothing in these Terms and Conditions seeks to exclude or limit Our liability for death or personal injury caused by Our negligence, fraud or other type of liability which cannot by law be excluded or limited.
  • These terms and conditions are governed by English law and any disputes which may arise with the The Reader re subject to the exclusive jurisdiction of the English Courts.

HEALTH AND SAFETY

  • Ticket holders must comply with all relevant statutes, safety announcements and regulations whilst attending the Event.
  • If Ticket holders have any special requirements or concerns about any special effects which may be featured at the Event, prior notice should be provided when ordering Tickets by emailing [email protected]
  • The event is held outdoors in a public park, so please be aware of ground conditions. You are strongly advised to bring appropriate footwear and clothing.
  • Special effects may include, without limitation, sound, audio visual, pyrotechnic effects or lighting effects.

SEVERABILITY

  • If it is found by a Court that any of these Terms and Conditions for any reason cannot be enforced, this shall not prevent the other provisions from continuing to apply.

THIRD PARTIES

  • Any person not a party to these terms and conditions will have no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these terms and conditions. These terms and conditions do not create any rights or obligations enforceable by or against anyone other than you or us.

FORCE MAJEURE

  • For the purposes of these terms and conditions, Force Majeure means any cause beyond our control including, without limitation, an act of God, war, insurrection, riot, civil disturbances, acts of terrorism, fire, explosion, flood, theft of essential equipment, malicious damage, strike, lock out, weather, third party injunction, national defence requirements, acts or regulations of national or local government. We will not be liable for failure to perform any obligation under these terms and conditions to the extent that the failure is caused by Force Majeure.

AMENDMENTS AND VARIATIONS

  • We intend to rely on the written terms set out here in this document as well as the written terms and conditions of the Promoter. You should read the terms and conditions carefully before entering into the contract to ensure that they contain everything that You consider has been agreed. If they do not, then you should speak to any member of staff. After the contract has been made, these Terms and Conditions cannot be varied or amended in any respect unless both You and We agree in writing.
